Phase I Environmental Site Assessments

Definition

Phase I Environmental Site Assessments, or ESAs, are performed to identify environmental conditions or liabilities, and normally include the following steps:

Site and vicinity reconnaissance
Regulatory agency files review
Aerial photography review
Historical title and land use review
Local agency file and database searches
Interviews with persons knowledgeable about site history
Information analysis and report preparation

Practical Applications

Phase I ESAs provide the documentation necessary to help protect property sellers, lenders, buyers from environmental liabilities. The Phase I ESA is the environmental disclosure documentation required by most institutions that finance commercial property purchases. Most Phase I ESAs are requested by parties that may become liable for cleanup of pre-existing environmental conditions at a property if discovered after completion of the transaction.
